1. General
Asklepieia Health Cluster S.A., a sociรฉtรฉ anonyme (S.A.) with registered address in Athens on 2 Viantos Str, postal code 10442, VAT registration number EL801253906 and with General Commercial Registry (GEMI) number 152787201000 (“Asklepieia”, “we”, “us”, or “our”) operates the website located at www.asklepieiahealth.com and other related websites and mobile applications with links to these Terms of Use (collectively, the “Website”). The services we offer (“Asklepieia Services”) include the online presentation of healthcare professionals and the coordination of the provision of health services enabling our users (“Users”) to report their health history and engage with healthcare professionals which are part of the Asklepieia network (“Healthcare Professionals”) to obtain medical and healthcare services. For the purposes of these Terms, “Healthcare Professionals” includes: (i) licensed physicians and dentists; (ii) licensed paramedical professionals practising under a regulated license issued by the competent authority of the jurisdiction in which they practise, including but not limited to psychologists, dietitian-nutritionists, physiotherapists, speech therapists, occupational therapists, nurses, and radiologists; and (iii) private clinics, polyclinics, diagnostic centres, rehabilitation centres, and private hospitals operating as legal entities, whether established in Greece or in any other jurisdiction. Where a Healthcare Professional is a legal entity (e.g. a clinic or hospital), these Terms apply to the legal entity and to the natural persons acting on its behalf. Healthcare Professionals established outside Greece shall comply with the applicable professional licensing requirements of their own jurisdiction.
The Asklepieia Services may also include coordinating with or presenting third-party accommodation or hospitality providers (collectively, “Hospitality Partners”). These Hospitality Partners are independent entities and not agents, employees, or joint ventures of Asklepieia. Asklepieia is not liable for any acts, omissions, pricing, quality of service, or for any damages or losses arising from your engagement with any Hospitality Partner or their respective staff.
The Asklepieia Services may also include presenting and coordinating with third-party wellness and wellbeing service providers (collectively, “Wellness Partners”). Wellness Partners include, without limitation: day spas, medical spas (medi-spas), yoga and pilates studios, mindfulness and meditation centres, holistic and alternative therapy providers, aesthetics and cosmetology centres, nutrition and dietetics practices, fitness and personal training facilities, and thalassotherapy centres. Wellness Partners are independent entities and are not agents, employees, or joint ventures of Asklepieia. Asklepieia is not liable for any acts, omissions, pricing, quality of service, or for any damages or losses arising from your engagement with any Wellness Partner or their respective staff. Wellness Partners who offer services that fall within a regulated healthcare profession (e.g. a medical spa offering procedures that require medical supervision) must hold the required professional licences and are subject to the same professional standards obligations as Healthcare Professionals under Section 14 of these Terms.
The Asklepieia Services include a referral and promotion programme through which registered promotional partners, referred to on the Platform as “Ambassadors” and in these Terms as “Affiliators” (the two terms are used interchangeably), promote the Platform and refer Users to Healthcare Professionals, Wellness Partners, and Hospitality Partners listed on the Platform. Affiliators register directly on the Platform and are subject to these Terms. The Affiliator role is exclusively promotional: Affiliators are not authorised to list their own services or packages on the Platform. An Affiliator who wishes to list services or packages must separately register as a Partner (Health, Wellness, or Hospitality) using the relevant registration form, or contact Asklepieia to request an account upgrade. Affiliators participate in the Platform under the access tiers described in the applicable Affiliate Agreement, which governs commission structures, payment terms, and revenue-sharing arrangements. Affiliators must in all cases clearly disclose their promotional relationship with Asklepieia to their audience in accordance with applicable advertising disclosure law (including ASEP guidelines and applicable national consumer protection law).
By accessing and using the website or any Asklepieia Services, you agree to be bound by these Terms of Use and all other terms and policies that appear on the website (“Terms”). If you do not wish to be bound by any of these Terms, you may not use the Website or the Asklepieia Services.
2. Modification of Terms
We may change these Terms or modify any features of the Asklepieia Services at any time. The most current version of the Terms can be viewed by clicking on the “Terms of Use” link as well as the “Privacy Policy” link in the footer menu of this website. You accept any changes to the Terms by continuing to use the website after we post the changes.
3. Healthcare Services
The Healthcare Professionals who deliver healthcare services (“Healthcare Services”) through Asklepieia are independent professionals practicing within a group of independently owned professional practices.
Asklepieia does not practice medicine or any other licensed profession and does not interfere with the practice of medicine or any other licensed profession by Healthcare Professionals, each of whom is responsible for his or her services and compliance with the requirements applicable to his or her profession and license.
Asklepieia does not define, supervise, or intervene in the practice, diagnosis, or treatment provided by Healthcare Professionals. We are not responsible for the tactics, medical methods, or professional advice provided. Furthermore, Asklepieia bears no medical, criminal, or civil liability for any actions, omissions, malpractice, unethical behavior, errors, or negligence of any Healthcare Professional.
Asklepieia does not promote, approve or suggest Healthcare Professionals and/or Healthcare Services. Asklepieia does have certain quality criteria that need to be fulfilled for a Healthcare Professional to become a member of the Asklepieia network or otherwise contracted with Asklepieia but those are not to be considered as an endorsement of any Healthcare Professionals and/or Healthcare Services by Asklepieia. Neither Asklepieia nor any third parties who promote the Healthcare Services or provide you with a link to the Healthcare Services shall be liable for any professional advice you obtain from a Healthcare Professional via the Asklepieia Services.
4. Website Content
All information and presentations provided on the Asklepieia website, including texts and articles, express the personal opinions of their authors and are for informational and advisory purposes only. Under no circumstances do they substitute for a professional diagnosis, treatment, clinical examination, or advice from a specialized medical professional. The User must not rely on information provided on Asklepieia or user comments on the website, as a substitute for medical advice and treatment. This information does not in any way replace professional medical advice, examination, diagnosis, and treatment.
None of the website content (other than information you receive from Healthcare Professionals) should be considered medical advice or an endorsement, representation or warranty that any particular medication or treatment is safe, appropriate, or effective for you.
The quality of any response via teleconsultation is inherently limited, regardless of the information provided, and is not a substitute for an in-person examination, nor can we ensure the timely answer of your questions to the medical professional via means of chat or e-mail or any other form of communication between You and the Professional.
The User should not neglect, avoid, or delay seeking medical advice from a competent medical professional because of any information they may have read on the Website. No statement or post on the Website is, nor can it be construed as, the practice of medicine or the provision of medical care. Any reliance by the user on information provided by Asklepieia is done exclusively and solely at their own risk.
FOR URGENT MEDICAL EMERGENCIES THAT REQUIRE IMMEDIATE ATTENTION AND/OR HOSPITALIZATION OR SEVERE MENTAL TRAUMA AND SUICIDAL THOUGHTS: Do not use this Website for urgent medical needs. If you are facing a medical emergency, call 112 (European emergency number), 166 (Greek ambulance), or your local emergency number and/or contact your personal physician immediately.
5. Booking Forms and User Information
In order to request to communicate with a Healthcare Professional of your choice, you must create an account to ensure platform security and manage your bookings and you will need to submit an online form in which you will have to fill-in personal data in relation to your identity and, optionally, some data relating to your medical condition, previous diagnosis, requested medical/ dental care etc. (“Ask for Treatment”, “Request to Book”, “Book and Pay” or other related Forms”). To submit the Ask for Treatment Form, you must be of at least 18 years of age. You can submit the Ask for Treatment Form on behalf of a minor child of whom you are parent or legal guardian. You agree that the information in the online Form will be true, accurate, current and complete.
If a minor is found to be using the platform without the approval of their guardian Asklepieia will terminate the account as per our terms of use and delete all account data.
6. Access Rights
We hereby grant to you a limited, non-exclusive, non-transferable right to access the Website and use the Asklepieia Website and Services solely for your personal non-commercial use and only as permitted under these Terms and any separate agreements you may have entered into with us (“Access Rights”). We reserve the right, in our sole discretion, to deny or suspend use of the Website or Asklepieia Services to anyone for any reason.
You agree that you will not, and will not attempt to: (a) impersonate any person or entity, or otherwise misrepresent your affiliation with a person or entity; (b) use the Website or Asklepieia Services to violate any law; (c) reverse engineer, disassemble, decompile, or translate any software or other components of the Website or Asklepieia Services or use scraping tools to extract information and potentially disrupt other users’ experience; (d) distribute viruses or other harmful computer code through the Website ; or (e) otherwise use the Asklepieia Services or Website in any manner that exceeds the scope of use granted above.
In addition, you agree to refrain from abusive language and behavior which could be regarded as inappropriate, or conduct that is unlawful or illegal, when communicating with Healthcare Professionals, Asklepieia Staff, the staff of Hospitality Partners or any other user through the Website.
Finally, you must not misuse the Asklepieia Services and should declare only actual and real health incidents. You should appear on appointments that you book through the Asklepieia Services platform or cancel these appointments on time.
Failure to comply can lead to permanent account deletion and legal actions if necessary.
Affiliator (Ambassador) Obligations: Affiliators who register on the Platform additionally agree to: (a) only promote Healthcare Professionals, Wellness Partners, or Hospitality Partners listed on the Platform in an accurate, fair and non-misleading manner; (b) clearly and conspicuously disclose their promotional relationship with Asklepieia in any content, post, article, social media publication, or communication directed at their audience, in accordance with applicable advertising and consumer protection law (including Article 9 of Law 2251/1994 and applicable ASEP guidelines); (c) not make medical claims, health guarantees, therapeutic promises, or comparative statements about Healthcare Professionals or Wellness Partners that are not substantiated by evidence; (d) not list, advertise, or offer any services, packages, or itineraries as their own on the Platform โ the Affiliator role is promotional only; (e) not use the Asklepieia brand or marks beyond what is expressly permitted by Asklepieia in writing; (f) promptly notify Asklepieia of any complaint, legal challenge, or regulatory inquiry related to their promotional activity; (g) if acting as a Travel Agent, DMC, or Medical Tourism Facilitator and wishing to list service packages on the Platform, contact Asklepieia to undergo the required vetting and account upgrade process prior to any such listing; and (h) not use any Asklepieia confidential information, materials, branding, or data for the benefit of a competing medical tourism, health tourism, or wellness tourism platform, and not display the Asklepieia Brand Certification Badge on any page, channel, or content that simultaneously promotes a competing platform. Where an Ambassador maintains active promotional relationships with platforms other than Asklepieia, the Ambassador shall disclose such relationships to Asklepieia upon request. For the avoidance of doubt, general travel agencies, hospitality booking platforms, and social media platforms that are not primarily focused on medical or wellness tourism shall not be considered competing platforms for the purposes of this clause.
7. Intellectual Property Rights
The Website and its entire contents, features and functionality (including but not limited to all information, software, text, displays, images, video and audio, and the design, selection and arrangement thereof), are owned by Asklepieia, its licensors or other providers of such material and are protected by Greek, European and international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.
These Terms permit you to use the Website for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit any of the material on our Website except as generally and ordinarily permitted through the Website according to these Terms or with our express written consent.
All rights in the product names, company names, trade names, logos, service marks, slogans, and designs of the Asklepieia Services, whether or not appearing in large print or with the trademark symbol, belong exclusively to Asklepieia or its licensors and are protected from reproduction, imitation, dilution, or confusing or misleading uses under national, European and international trademark and copyright laws.
The use or misuse of these trademarks or any materials, except as authorized herein, is expressly prohibited, and nothing stated or implied on the Asklepieia Services confers on you any license or right under any patent or trademark of Asklepieia, its affiliates, or any third party.
Provider Content License: By uploading logos, images, service descriptions, or other content to your profile on the Platform (“Provider Content”), you grant Asklepieia a non-exclusive, worldwide, royalty-free license to display, reproduce and distribute the Provider Content solely for the purpose of operating the Platform and promoting your services on the Platform. This license terminates when you remove the content or close your account. Directory Profile listings use only data from publicly available sources and do not include copyright-protected images without authorisation.
8. Fees and Payment Terms
Asklepieia operates an electronic payment system through which you will be prompted to pay for the Healthcare Services you receive. Asklepieia uses licensed third-party payment processors to facilitate secure financial transactions between you and Healthcare Professionals, Wellness Partners, or Hospitality Partners.
Provider subscriptions are governed by separate B2B subscription agreements. Subscription terms, including duration, renewal, and cancellation conditions, are set out in the applicable Subscription Agreement between Asklepieia and the Healthcare Professional.
Additionally, for payments processed via the IRIS service, Asklepieia utilizes the infrastructure of EveryPay.
Security of Transactions via EveryPay: Recognising the importance of electronic payment security, EveryPay is a licensed Payment Institution by the Bank of Greece (Decision No 280/3/23-7-2018 Government Gazette, Series II, No 3010/25-7-2018), and securely manages payment means transaction data, in accordance with the regulatory framework of the transaction security management standard for respective means and services. EveryPay is certified in accordance with the card transaction management data security standard (PCI DSS), and is subject to periodic audits by a specialized consulting firm. All EveryPay services are made through secure connections with 256 bit SSL certificates. EveryPay also supports the capability to use the 3D Secure service, an additional security safeguard for VISA & MasterCard cards. The payer will then be required to enter their personal secret code to complete the transaction successfully.
The use of those third-party platforms means that you the USER must comply with the third party’s platform terms and conditions and provide accurate data. Issues arising via delay of funds or refunds between a Healthcare Professional and a patient because of the disruption of said third party platforms must be dealt between the platform and the interested party.
Through the electronic payment system of Asklepieia and/or the Healthcare Professional of your choice, you will be duly informed about the fees and charges for the Healthcare Services, as well as the payment process.
You agree to pay all fees or charges in accordance with the fees, charges, and billing terms in effect at the time a fee or charge is due and payable.
By providing Asklepieia with your credit card number and associated payment information, you agree that Asklepieia is authorized to immediately charge your account for all fees and charges due and payable hereunder and that no additional notice or consent is required. Once your account has been charged, you will receive a) a transfer receipt from Asklepieia b) an order confirmation from Asklepieia, c) an invoice from the relevant Healthcare Professional following the provision of the selected healthcare service.
In the case that it is not possible or practicable to pay the fees and charges through the Asklepieia payment platform, you agree to pay the said charges and fees directly to the Healthcare Professional. Once payment has been made, you will receive an invoice from the relevant Healthcare Professional.
If you do not have insurance coverage for Healthcare Services, or if your coverage is denied, you acknowledge and agree that you shall be personally responsible for all incurred expenses. Asklepieia offers no guarantee that you shall receive any such reimbursement.
8.1 Disputes, Insurance, Cancellations
- Financial Disputes: Any dispute, disagreement, or claim regarding a financial transaction, including fees and billing, concerns exclusively the User and the Healthcare Professional. Such matters must be resolved between the parties without the mediation or involvement of Asklepieia.
- Pricing and Insurance: Asklepieia does not set the cost for visits or services. We are not responsible for the Healthcare Professional’s compliance or non-compliance with their obligations under any contract they may have with a national insurance provider (e.g., EOPYY) or private insurance company.
- Cancellation & Refund Policy: Wellness and Hospitality Partner Cancellations: The cancellation and refund policies set out above apply, mutatis mutandis, to services booked through Wellness Partners and Hospitality Partners listed on the Platform. Each Wellness Partner and Hospitality Partner defines their own cancellation and refund policy, which will be communicated to the User at the time of booking. Asklepieia does not manage or guarantee refunds for services provided by Wellness Partners or Hospitality Partners.
- Third-Party Payment Processors: For payments made through financing partners (e.g., Klarna), a separate refund and payment policy dictated by that third party may apply. Users agree to adhere to the terms of the respective payment processor.
- Technical Issues: In the event of a technical failure originating from the Asklepieia platform that prevents a prepaid service (e.g., a video call) from being completed, the User will not be charged.
9. Termination
You may stop using the Asklepieia Services at any time, for any reason. Subject to applicable law, Asklepieia reserves the right to maintain, delete or destroy all communications and materials posted or uploaded to the Website pursuant to its internal record retention and/or content destruction policies. After such termination, Asklepieia will have no further obligation to provide the Asklepieia Services, except to the extent that we are obligated to provide you access to your health records or Healthcare Professionals are required to provide you with continuing care under their applicable legal, ethical and professional obligations to you.
10. Disclaimer of Warranties
YOU EXPRESSLY AGREE THAT USE OF THE WEBSITE OR ASKLEPIEIA SERVICES IS AT YOUR SOLE RISK. Both the Website and Asklepieia Services are provided on an “AS IS” and “AS AVAILABLE” basis. We do not guarantee that the Website will be compatible with every User’s device, hardware, or software.
ASKLEPIEIA EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, whether express or implied, including, but not limited to any warranties of merchantability, fitness for a particular use or purpose, non-infringement, title, operability, condition, quiet enjoyment, value, accuracy of data and system integration.
11. Limitation of Liability
YOU UNDERSTAND THAT to the extent permitted under applicable law, IN NO EVENT WILL ASKLEPIEIA ITS OFFICERS, EMPLOYEES, DIRECTORS, PARENTS, SUBSIDIARIES, AFFILIATES, AGENTS OR LICENSORS BE LIABLE for indirect, incidental, special, consequential or exemplary damages, including but not limited to damages for lost profits, responsibility from negotiations, use, data or other intangible losses arising out of or related to your use of the Website or the Asklepieia Services, regardless of whether such damages are based on contract or tort (including negligence and strict liability), warranty, statute or otherwise.
Further, Asklepieia is not liable for:
(i) Damages or losses arising from any transaction between you and any Healthcare Professional,
(ii) The availability and accuracy of the content, products and services of any of the Healthcare Professionals &
(iii) Any delay or failure of provision of Asklepieia and/ or Healthcare Services which is due to causes beyond our reasonable control.
Although Asklepieia makes every possible effort to protect the Website from digital viruses or other harmful files, we cannot guarantee that the Website will never be infected. The integrity and preservation of each User’s software and equipment are their own responsibility, and Asklepieia will not bear any liability in case of infection of a User’s electronic equipment.
While Asklepieia offer teleconsultation Services in this website as well as live chat and video call services, Asklepieia is not responsible for problems arising from improper use of equipment by the User or Healthcare Professional, nor for inadequate equipment or things outside Asklepieia’s control like signal strength or issues with your service provider.
Asklepieia reserves the right at any time to temporarily or permanently interrupt the operation of the entire Website or a part of it for maintenance, upgrades, or any other reason, without any further liability.
To the extent that we may not, as a matter of applicable law, disclaim any implied warranty or limit its liabilities, the scope and duration of such warranty and the extent of our liability will be the minimum permitted under such applicable law.
12. User-Generated Content and Reviews
The Website may incorporate features allowing Users to post reviews of Healthcare Professionals through third-party platforms, such as Google Business Profiles. Asklepieia does not control and is not responsible for the content, accuracy, or management of these third-party reviews.
Asklepieia reserves the right not to publish or to facilitate the removal of reviews that contain abusive or offensive content, personal data, or details regarding a medical diagnosis or prescription, in accordance with the policies of the third-party platform. By using such features, you agree to comply with the terms and conditions of the third-party platform.
Asklepieia may incorporate reviews that are not handled by third party platforms as well using its own technology and resources. Asklepieia in that case reserves the right, in its sole discretion, not to publish or to remove reviews that contain abusive or offensive content, personal data, or details regarding a medical diagnosis or prescription, or for any other reason, without notice.
While Healthcare Professionals may be given an opportunity to respond to reviews, Asklepieia is not an arbiter of disputes and does not guarantee the accuracy, timeliness, or fairness of any review. Asklepieia assumes no liability for any user-generated content it chooses to publish, not publish, or remove.
13. Indemnification
You agree to indemnify, defend and hold harmless Asklepieia, Healthcare Professionals and their officers, directors, employees, agents, subsidiaries, affiliates, licensors, and suppliers, harmless from and against any claim, actions, demands, liabilities and settlements, including without limitation reasonable legal and accounting fees (“Claims”), resulting from, or alleged to result from improper use of the website or your violation of these Terms.
14. Professional Standards
Healthcare Professionals listed on the platform fall into two categories: ‘Verified’ and ‘Directory Profile.’
Verified Professionals: Healthcare Professionals designated as ‘Verified’ have entered into a contractual relationship with Asklepieia and have represented to us that they hold the necessary professional licenses in the areas where they practice. Asklepieia has made a good-faith effort to confirm the validity of their primary medical license as of the date of their verification.
Directory Profile Listings: Profiles designated as ‘Directory Profile’ are listings created from publicly available professional directory data (e.g., from public registries or third-party sources like Google Business Profiles) that have not yet been claimed or verified by the Healthcare Professional. Asklepieia has not contacted these professionals, does not have a contractual relationship with them, and makes no representation or warranty regarding their current licensure, status, or qualifications.
Disclaimer: The ‘Verified’ designation is not an endorsement or guarantee of the professional’s skill or quality of care. For ‘Directory Profile’ listings, Asklepieia acts solely as a search engine/directory and assumes no liability for the accuracy of the data. You must not rely on any listing as a substitute for your own due diligence.
GDPR Notification (Article 14): In accordance with Article 14 of the General Data Protection Regulation (EU 2016/679), Healthcare Professionals whose details appear in a Directory Profile listing will be notified of this processing within one (1) month of the profile being created. Notification will be sent to the contact address available from the source from which the data was obtained. For full details of your rights as a data subject, please refer to our Privacy Policy at www.asklepieiahealth.com.
Claim or Remove Profile: Any Healthcare Professional listed as a Directory Profile may at any time: (a) claim their profile to become a Verified member of the Asklepieia network; (b) request correction of inaccurate or outdated information; or (c) request complete removal of their profile. To exercise any of these rights, please contact our Data Protection Officer at [email protected] or use the “Claim/Remove Profile” function on the listing page. Requests will be processed within 30 days.
In all cases, Asklepieia is not liable for the accuracy of the information of each individual profile and You can report a complaint relating to the care provided by a Healthcare Professional by contacting the professional licensing association in the area where the care was received. In a professional relationship, sexual intimacy is never appropriate and should be reported to the association or agency that licenses, registers, or certifies the licensee.
You can seek the contact information for each of the local professional licensing associations governing medicine or dentistry on their respective official websites.
14.1 Asklepieia Quality Mark & Brand Certification Certain Healthcare Professionals may display the “Asklepieia Evaluated Member” (also referred to as the “Brand Certification Badge” or the “Badge”) mark. You acknowledge and agree that this distinctive mark signifies only that the provider has undergone the Asklepieia Quality Assessment
The assessment evaluates the provider based on a proprietary multi-factor assessment regarding:
- Professional Standing: Verification based on the provider’s binding contractual declarations regarding licensure.
- Quality & ESG Commitment: Assessment of the stated commitment to transparency and ESG awareness.
Disclaimer regarding the Mark: This seal is a private quality mark awarded exclusively by Asklepieia based on a review of data and formal representations submitted by the provider at the time of assessment. It is NOT an official certification, accreditation, or forensic verification of documents by a National or International Body. It does NOT guarantee medical outcomes, safety conditions, or imply possession of ISO certifications unless explicitly listed in the provider’s verified profile. Asklepieia operates as an independent intermediary and relies on the accuracy of the provider’s contractual warranties.
14.2 Asklepieia Hospitality & Wellness Standards Certain Accommodation and Wellness providers may display the “Asklepieia Evaluated Member” mark. You acknowledge and agree that this distinctive mark signifies only that the provider has undergone the Asklepieia Quality Assessment, a documentary evaluation process based on the proprietary Asklepieia Excellence Framework for Hospitality and Wellness.
The assessment evaluates the provider based on a proprietary multi-factor assessment regarding:
- Hospitality & Facility Standards: Validation of the provider’s Authorized Operation License (e.g., MHTE) and Star Rating based on binding contractual declarations.
Disclaimer regarding the Mark: This seal is a private quality mark awarded exclusively by Asklepieia based on a review of data and formal representations submitted by the provider. It is NOT an official certification, accreditation, or forensic verification of documents by a National or International Body. It does NOT guarantee guest safety, elimination of risk, or imply possession of specific ISO/HACCP certifications unless explicitly listed in the provider’s verified profile. Asklepieia operates as an independent intermediary and relies on the accuracy of the provider’s contractual warranties.
15. Website Links
The Website may contain links to third-party websites. The use of third-party websites is at the User’s own risk and is subject to the terms of use of those websites.
WE WILL NOT BE LIABLE FOR ANY information, software, or links found at any other website, internet location, or source of information, nor for your use of such information, software or links, nor for the acts or omissions of any such websites or their respective operators.
16. Privacy and Communications
Asklepieia is required to comply with European and Greek healthcare privacy and security laws and maintain safeguards to protect the security of your health information. Additionally, the information you provide to your Healthcare Professional during a medical consultation or therapy session is legally confidential. By using the Asklepieia Services, you also consent to our processing of your information consistent with our Privacy Policy. Information regarding our use of health and other personal information is provided in our Privacy Policy, which is hereby incorporated by reference into these Terms.
As part of providing you with the Asklepieia Services, we may need to provide you with certain communications such as appointment reminders, service announcements, privacy notices, administrative messages, assessment questionnaires and other communications about the Asklepieia Services (“Communications”).
These Communications are considered part of the Asklepieia Services. You understand that by checking the “agree” box for these Terms and/or any other forms presented to you on the Website you are agreeing to these Terms and that such action constitutes a legal signature. You agree that we may send to you Communications through electronic means including but not limited to: (1) by email, using the address that you provided to us in the “Ask for Treatment”, “Book and Pay” “Request to Book” or other type of Form, (2) short messaging service (“SMS”) text message to the mobile number you provided us in the above Forms (“SMS Messages”), (3) push notifications on your tablet or mobile device, or (4) by posting Communications on the Website. The delivery of any Communications from us is effective when sent by us, regardless of whether you read the Communication. You can withdraw your consent to receive Communications by unsubscribing through the link at the bottom of each electronic communication. While secure electronic messaging is always preferred to insecure email, under certain circumstances, insecure email communication containing personal health information may take place between you and Asklepieia. Asklepieia cannot ensure the security or confidentiality of messages sent by email.
17. Brand Certification and Referral Attribution Programme
17.1 Asklepieia Evaluated Member Badge. Verified Partners (Healthcare Professionals, Wellness Partners, and Hospitality Partners) who are members of the Asklepieia network may display the Asklepieia Evaluated Member badge (the “Badge”) on their own websites, premises, and marketing materials. The Badge certifies that the Partner has completed Asklepieia’s onboarding and verification process. The Badge simultaneously functions as a call-to-action (CTA) link redirecting visitors to the Asklepieia Platform. Partners may not modify, alter, or reproduce the Badge outside the guidelines provided by Asklepieia, and the licence to display the Badge terminates automatically upon termination of the Partner’s agreement with Asklepieia. The Badge contains an embedded hyperlink that collects pseudonymised click and session data as described in Section 17.2. Partners displaying the Badge on their websites are responsible for disclosing this data processing in their privacy notice. The physical or digital Asklepieia Evaluated Member certificate issued to Partners is governed by these Terms and does not confer any rights beyond those set out in this Section 17.
17.2 Cross-Partner Referral Commission. Where a visitor who accessed the Asklepieia Platform via a Partner’s Badge subsequently completes a booking of a cross-category service (i.e., a visitor originating from a Healthcare or Wellness Partner’s Badge completes a Hospitality booking, or a visitor originating from a Hospitality Partner’s Badge completes a Healthcare or Wellness booking), the originating Partner receives a referral commission at the rate specified in the Partner’s individual agreement with Asklepieia (the “Cross-Partner Commission”). Attribution is determined solely by anonymous click-tracking technology. No personal data of the visitor or patient is processed for attribution purposes; only pseudonymised session and conversion data is used.
17.3 No Connection to Medical Services. The Cross-Partner Commission is paid exclusively as remuneration for platform traffic attribution and cross-category booking conversion. It is in no way connected to, dependent upon, or in consideration of: (a) any medical consultation, procedure, or healthcare service; (b) any medical referral or direction of a patient to a specific Healthcare Professional or treatment; or (c) any clinical decision or recommendation. Healthcare Professionals participating in this Programme are expressly prohibited from using the Badge or any commission incentive as a factor in, or inducement related to, any clinical recommendation made to patients. This clause reflects and reinforces the prohibition under Article 18 of Law 3418/2005 (Greek Code of Medical Ethics). The Cross-Partner Commission is a standard affiliate attribution payment of the same nature as those used in e-commerce and online marketplace environments globally.
17.4 Tax and Invoicing. Cross-Partner Commissions constitute taxable income for the receiving Partner. Each Partner is solely responsible for declaring and paying any applicable taxes. Where required by Greek or applicable law, the Partner must issue a valid invoice or receipt to Asklepieia prior to payment. Asklepieia reserves the right to withhold payment until a valid tax document is received.
18. Miscellaneous
18.1 Governing Law and Jurisdiction. These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of Greece, without regard to its conflict of law principles. The courts of Athens, Greece shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms, subject to the alternative dispute resolution provisions of Sections 18.2 and 18.3 below.
18.2 Dispute Resolution โ EU/EEA Parties. Where a party is established or resident within the European Union or the European Economic Area, any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of the city of Athens, Greece, to which both parties irrevocably submit.
18.3 Dispute Resolution โ Non-EU/EEA Parties. Where a party is established or resident outside the European Union and the European Economic Area, any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by arbitration under the Rules of Arbitration of the International Chamber of Commerce (ICC), by one or three arbitrators appointed in accordance with the said Rules. The seat of arbitration shall be Athens, Greece. The language of the arbitration shall be English. The award shall be final and binding upon the parties. This clause does not prevent either party from seeking urgent interim or injunctive relief from a court of competent jurisdiction.
18.4 Electronic Signatures. The parties agree that these Terms and any agreement, notice, disclosure or other communication provided or entered into pursuant to these Terms may be executed or authenticated by electronic signature. For parties established within the EU/EEA, electronic signatures shall be recognised in accordance with Regulation (EU) No 910/2014 (eIDAS). For parties established in the United Kingdom, electronic signatures shall be recognised in accordance with the Electronic Communications Act 2000 and the Electronic Signatures Regulations 2002. For parties established in the United States, electronic signatures shall be recognised in accordance with the Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and the Uniform Electronic Transactions Act (UETA). For parties established in other jurisdictions, the parties agree that an electronic signature shall be deemed valid if it reliably identifies the signatory and reliably indicates the signatory’s intention with respect to the information signed, consistent with applicable law.
18.5 Language. These Terms are drawn up in the English language. The English text of these Terms is the authoritative and binding version for all international relations. A Greek translation may be made available for compliance purposes in Greece; in the event of any conflict or inconsistency between the English and Greek versions, the English version shall prevail for parties domiciled or established outside Greece. Nothing in this clause affects the right of a consumer established in Greece to receive communications in Greek as required by applicable Greek consumer protection law.
No waiver by Asklepieia of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Asklepieia to assert a right or provision under these Terms shall not constitute a waiver of such right or provision. If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
